Can genetic parents change their minds?

Postby admin » Wed Apr 09, 2008 6:45 pm

Under current law, once the embryos have been transferred, the genetic parents have no legal claim to any resultant children. The contract agreement and relinquishment forms are legally binding between the two families.

I was not clear in what I was asking. Sorry. If both gentic and adoption parent's of the embyo's have signed every thing and both have agreed to an open adoption, and there was a baby born, can the adoption parent's then change there mind and not let the genetic parent's have any updates or knowledge of the baby.

So, are you saying even tho both set's of parent's agreed to an open adoption the adopting parent's can then change there mind and not let the genetic parent's know anything about the baby even tho that is why the gentic parent's chose the couple is because they agreed to let them be in the baby's life.

If the contract's signed are legally binding and the adoptive parents did not do what was in the contract that that signed then it would be considered a breech in contract.
Correct?

Yes, it would be a breach of contract. However we don't know if the contract for open embryo adoption would be enforced if it were tested in court. To our knowledge it hasn't been tried yet.

Thanks
